 民眾提點子成案 剝奪人民基本權不能公投

（中央社記者劉麗榮台北8日電）聯合國官員批評同婚公投，認為人權不該表決。有民眾提案，不得透過提公投案剝奪、限制或減少人民享有的基本權。短短幾天已成案，中選會必須在明年2月6日前回覆

國家發展委員會設立的公共政策網路參與平台的「提點子」服務，開放民眾就關注的議題提案，60天內附議人數達5000人即成案，主管機關須於2個月內具體回應參採情形，並且在平台上公布。

依據現行公投法第2條規定，預算、租稅、薪俸及人事事項不能公投。全國性公民投票，依憲法規定外，其他適用事項包括法律的複決、立法原則的創制和重大政策的創制或複決。

由於人權並未納入不能公投事項，有民眾在公共政策網路參與平台提議修正「公投法」，以法律明定不得透過提出公投案的方式來剝奪、限制或減少人民享有的基本權。其提出的公投案內容意在保障、增加人民權益公投，不在此限。

東吳大學法律系副教授胡博硯指出，美國、德國的公投法都有規定，人權不能公投，不過，他們是可以推動修憲公投，所以才會有此規定。而台灣的公投法是在憲法架構下，有關修憲議題是不能公投的，所有公投題目都只能修法，不能違背或修改憲法。（編輯：鄭雪文）1071208

 擦擦詐大慶1200 擦擦筆改寫支票 大慶前董座再爆遭詐28億

大慶證券前董事長莊隆慶，傳出跳票21億，不過他的債務恐怕不只如此，因為他說更早之前被領走28億，很多張支票都出現問題，檢察官一路查，發現案情不單純只是莊隆慶被詐騙，其中10億元還跟股市名人鄭光育、借殼大戶鄧福鈞等人有牽連，可能牽扯上去年的炒股案。

檢調調查，捷泰、聯光通等3檔股票，去年跌停，金主散戶紛紛殺出，而承接買盤的資金，疑似就是莊隆慶支票，所調借來的現金，等於把他又變成炒股彈藥庫。大慶證券則表示一切都是前董事長個人財務問題，目前切割開來。跳票案、擦擦筆詐騙到炒股案，案情高潮迭起，就看檢調如何查出真相。
